BUY AMERICAN ACT (BAA)

The Buy American Act (BAA) restricts federal agencies' ability to purchase non-U.S. goods by providing a pricing preference to domestically produced goods. The BAA stipulates that the end-product, as well as over 50% of the total cost of component parts, must be manufactured in the U.S. If a product meets these requirements, then a product can be considered a “domestic end product” under the Buy American Act.

BUILD AMERICA, BUY AMERICA ACT (BABAA)

The Build America, Buy America Act (BABAA) applies a domestic content procurement preference requirement (Buy America Requirement) to Federally funded public infrastructure projects with the goal of increasing a resilient domestic supply chain and manufacturing supply for critical materials in the U.S.

The BABAA is often attached to the Federal Transit Administration (FTA), Federal Highway Administration (FHWA), and Federal Aviation Administration (FAA) grants on transportation projects
